Rutherford Shell 1932-" "Com. vs Ernest Payne 1932" According to documents from the Courthouse Records: "State of Virginia- In the Circuit Court for Fauquier County, to-wit: The Jurors for the commonwealth of Virginia in and for the body of the County of Fauquier, and now attending the Circuit Court of the said County at its January Term, 1933, upon their oath present: That Ernest Payne on the 26th day of December, 1932, in the County of Fauquier, feloniiously did kill and Murder Homer L. Rutherford, against the peace and diginity of the commonwealth. Upon the evidence of Ruth Rutherford and George H. Davis, witnesses sworn in open court and sent before the gran jury to give evidence" Next document says the jury found him not guilty These documents are in our research files, not accessioned |
